Why We Oppose the Wisconsin IVF Tax Credit Bill (LRB 4566/1 and LRB 5420/1)
The Building Families Alliance of WI is now over 1,000 people strong and represents constituents from every one of Wisconsin's 33 Senate Districts. We encourage any state policy maker to connect with those of us living with infertility or providing care for over 172,000 patients in our state. Unfortunately new legislation has been introduced without connecting with and consulting with our coalition that has been working on the issue of infertility for the past five years. We support the Building Families Act (SB 566 & AB 568) which offers meaningful financial support for those seeking to build the family of their dreams.
1. Real solutions already exist — and they’re being ignored.

Wisconsin lawmakers already have a bill - The Building Families Act - on the table that would require insurance companies to cover infertility treatment, including IVF.

That is the only policy mechanism that meaningfully lowers costs and expands access.

Instead of advancing that real solution, these lawmakers are offering a political stunt.
2. Insurance coverage for IVF is affordable — cheaper than a cup of gas station coffee.

Independent actuarial studies consistently show that insurance coverage for IVF increases premiums by less than $1 per member per month.

That’s literally cheaper than a cup of coffee — and it meaningfully expands access to care.

This is a low-cost, high-impact policy solution that already works in 23 states.
3. What they’re proposing isn’t IVF protection — it’s political theater.

A nonrefundable tax credit is not coverage.

And it is not money in patients’ pockets — despite how it’s being marketed.

Nonrefundable credits only reduce tax liability. If a patient doesn’t owe taxes — or owes less than the credit — they get nothing. o For example, say you have a refund of $2,000, you will only get $3,000 of that credit.

IVF patients are being misled into thinking they’ll get financial help when, in reality, most will never see a dime.

The same legislators who introduced this legislation wouldn't even add their support to a resolution recognizing National Infertility Awareness Week earlier this year.
4. IVF patients deserve honesty, not deceptive policy.

The price of an IVF cycle in Wisconsin is often $20,000–$30,000.

A nonrefundable $5,000 credit — even if collectible — barely dents that, and for many it won’t apply at all.

It’s irresponsible to pretend that this patchwork, symbolic approach “helps” families when it clearly doesn’t.

Tax credits in general, further stigmatize the family building community.
5. These lawmakers are exploiting confusion about how taxes work.

They are banking on voters not understanding tax terminology.

By using the phrase “tax credit,” they imply direct financial help — which is completely untrue for nonrefundable credits.

Families navigating infertility deserve clarity and compassion, not sleight-of-hand accounting tricks.
6. Wisconsin families need real protections — the kind that insurance mandates provide.

23 states already require fertility or IVF coverage.

Those states show dramatically higher access to care and fewer financial barriers.

Wisconsin can do the same by passing the existing insurance-mandate bill — not pushing fake fixes.
7. IVF access should not depend on your tax bracket.

Access to medical care cannot hinge on how much income tax a person owes.

A nonrefundable credit helps higher-income households the most and leaves many Wisconsinites behind.

True equity comes from insurance coverage, not tax gimmicks.
8. Families are tired of being used as political props.
